Instructions - Information on exercising the right of withdrawal for consumers

Right to withdraw from the contract for distance orders

(Applies exclusively to consumers within the meaning of the Consumer Protection Act)

You have the right to withdraw from this contract within 14 (fourteen) days without giving any reason.

The withdrawal period is 14 (fourteen) days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, TZS FIRST E Commerce GmbH, Raimundgasse 1/8, A-1020 Vienna, Austria, Email info@firstaustria.eu, of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached model withdrawal form, but this is not mandatory.

You can also electronically fill out and submit the model withdrawal form or any other clear statement on our website. If you make use of this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Information obligation

If we have not fulfilled our information obligation according to §4 para 1 Z8 FAGG, your right of withdrawal will be extended by 12 (twelve) months. If we fulfill our information obligation within this period, the withdrawal period ends 14 (fourteen) days after the date on which you received instruction on the right of withdrawal from us.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

Costs of returning the goods upon withdrawal

The costs for the return – with the exception of returns within Germany or Austria – are to be borne by you as the customer.

You only have to pay for any loss in value of the goods if this loss in value is due to handling that was not necessary for checking the quality, characteristics and functionality of the goods. However, you are in no case liable for the loss of value of the goods if you have not been informed by us about your right of withdrawal.

Exclusion/Expiry of the right of withdrawal

According to § 18 FAGG, a right of withdrawal does not exist, among other things, for contracts for the delivery of goods that can spoil quickly or for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.

Furthermore, the right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery, as well as for sound or video recordings or computer software supplied in a sealed package if their seal has been removed after delivery.
